 DRC Miners Seek Delay on Worker Equity Rule

Mining companies operating in the Democratic Republic of Congo are seeking a postponement of a government directive requiring them to allocate a 5% equity stake to Congolese employees before a July 31 deadline, according to industry sources and labour representatives.

The measure, contained in a January circular issued by the government, is part of broader efforts to increase local participation in the country’s lucrative mining industry. The Democratic Republic of Congo is the world’s largest producer of cobalt and one of the leading producers of copper, minerals that are critical to the global energy transition.

Industry representatives argue that important aspects of the directive remain unclear. Among the concerns raised are whether existing shareholders would be required to surrender part of their holdings and whether the rule should apply to mining operations established before the directive was issued.

The Chamber of Mines has reportedly requested a moratorium to allow further consultations between government officials, mining companies and other stakeholders. Several major international mining firms operating in the country are said to support the request as they seek clarity on how the policy will be implemented.

Labour unions, however, are pushing for immediate enforcement of the requirement. Union leaders accuse mining companies of delaying compliance and argue that Congolese workers should begin benefiting directly from the wealth generated by the country’s mineral resources.

The Ministry of Mines is expected to meet with union representatives to discuss the directive and address concerns surrounding its implementation. No mining company has yet complied with the requirement, according to labour officials.

The debate reflects a broader trend across Africa, where governments are increasingly seeking greater local participation and economic benefits from extractive industries as global demand for strategic minerals continues to grow.
